Macau Trademark Registration-Advantages
It is not necessary to register a trademark in the Macau SAR before a person could use it on his products or services. A trademark owner with either a registered or an unregistered trademark may protect the mark under “Action of Unfair Competition” under the “Macau Commercial Code”. An “Action of Unfair Competition” requires proof that the owner enjoyed prior reputation and damage inflicted on to his mark.
However, the registration of a trademark under the “Industrial Property Code” gives an owner the right to prevent third parties from using his mark, or a deceptively similar mark, without the owner’s consent for the products or services for which it is registered. He may also prevent other persons from using the mark in relation to products or services for which his mark is registered or in relation to similar products or services.Registration therefore gives a right of ownership that is easier to establish than under the “Commercial Code”.
Macau Trademark Registration-Macau Trademark Types
1 Product trademark: a trademark used on products or their packaging.
2 Service trademark: a trademark used in the course of the rendering of a service, in order to identify the service provider.
3 Association trademark: a specific sign belonging to an association of individuals and/or bodies corporate, whose members use or have the intention of using the sign for products or services.
4 Certification trademark: a specific sign belonging to a corporate entity that controls the products or services or establishes the regulations with which they must comply and that is to be used on the products or services subjected to that control or for which the regulations were established.
5 Three-dimensional trademarks: a trademark based on the 3D appearance of the product or its container.
6 Sound trademarks: a type of non-physical trademark that uses a specific type of sound used in trademark registration. A product or a type of service may be represented by means of a distinct tone or strings of tones.
Macau Trademark Registration-Required Documents
To register a trademark in Macau the following information will be necessary:
1 Name, nationality and address of the applicant;
2 Nature of business (industrial, commercial or other);
3 Reproductions of the mark. They need to be in colour if colour is claimed as a distinctive feature of the mark;
4 List of products or services
5 Power of attorney.
Macau Trademark Registration-Processing Time
The application for trademark registration in Macau generally takes between 12 to 24 months to complete. Upon registration, a registered trademark is first valid for 7 years and is renewable indefinitely for further periods of 7 years each by paying the renewal fee.
